Our company, and its suppliers, will not be liable for any damages whatsoever, including without limitation, damages for loss of business profits, business interruption, loss of business information, or other pecuniary loss. Some states do not allow the exclusion or limitation of liability, so the above limitations may not apply to you.Legal Forum, Choice Of Laws & Official Language This offering is a contract between you the buyer and our business, the seller. The seller is located in Mostar, Bosnia and Herezegovina and by doing business with us you agree that this offering is made from Mostar, Bosnia and Herzegovina and shall be governed by the laws of Bosnia and Herzegovina. By electing to participate in this offer, you are entering into a contract. This Agreement shall be governed by and construed in accordance with the laws of Bosnia and Herzegovina, without regard to its conflict of laws rules. Any legal action arising out of this Agreement shall be litigated and enforced under the laws of Bosnia and Herzegovina. In addition, you agree to submit to the jurisdiction of the courts of Mostar, Bosnia and Herzegovina, and that any legal action pursued by you shall be within the exclusive jurisdiction of the courts of Mostar, Bosnia and Herzegovina. The terms constituting this offering are set forth in writing on this Web site. You hereby agree to submit to the jurisdiction of the Courts located in Mostar, Bosnia and Herezegovina to resolve any disputes or litigation hereunder. Whether or not you choose to print this offering, containing the terms and conditions as described herein, you agree that this contract constitutes a writing. This agreement is being written in English, which is to be the official language of the contractç´ text and interpretation. If you do not agree with the above terms and conditions, you have the option not to participate in this offer. DigitSec.info performs due diligence on all certified websites, however, we cannot be held liable if a website modifies it's structure or information without informing us. We cannot be held responsible for any damage, financial or other loss, you may encounter using our customers' websites.
Refund Policy We are offering you a 14 day trial to test our services. Once the trial is over, customers will be charged a monthly subscription fee. Customers may cancel their trial or subscription at any time. If they cancel the trial, they can request a refund for the trial amount. All customers that request a refund of the trial will be refunded. No refunds shall be given after the trial period is over: we will NOT refund any monthly subscription fees. If you're not planning on using our services, cancel the 14 day trial. Customers are responsible to perform the cancellations of the trial or the monthly subscription themselves. No refunds for the monthly subscription fee(s) shall ever be issued, even if a customer's website is rejected (read Terms Of Use) after the payment is sent. Customer's websites and their content are sole responsibility of the customer in question. DigitSec is NOT and cannot be held responsible for customers who submit websites that do not obide by our website submission terms and then expect to be refunded.
Terms Of Use
Any customer may join our website and use our services. Some members may be offered a free membership, other may be required to pay a membership fee. (see: Refund Policy) Members are only allowed to submit one (1) website per account. If a customer wants to verify another website, the customer should join us again with a new e-mail address. The website that a customer submits for verification must obide by our website submission terms located at http://www.digitsec.info/terms.html. If a website status is pending, it means it has not been reviewed yet. If a website status is "rejected", the submitted website doesn't obide by our website submission terms and the customer will be asked to make the necessary changes in order for the website to be approved. An "approved" or "verified" website is a website that passed DigitSec's review. After a website is reviewed, the customer will be contacted via the e-mail address we have on file and will be asked to respond to the e-mail within seven (7) days in order to confirm that e-mail address. If a customer doesn't confirm the e-mail adress within seven (7) days, the website will be marked as "rejected". Once the e-mail address is confirmed, the customer will be asked to submit a valid telephone number and will be contacted via that telepone number by a DigitSec employee in order to verify that number. If a telephone nubmer is not confirmed, the website will be marked as "rejected". Once the telephone nubmer is confirmed, DigitSec will send a confirmation letter to the customer's physical address. That letter includes a 4-digit confirmation code that the customer must enter on our website in order to confirm the physical address. Customer has 45 days (starting date being the confirmation letter sending date) to enter the confirmation code on our website. If a physical address is not confirmed after 45 days, the website will be marked as "rejected". A website will be "confirmed" or "verified" after the telephone number is verified. A customer with a "confirmed" of "verified" website has access to our graphics. If a telephone number is verified and the customer's website is then verified, but the customer does not verify the physical address 45 days after the verification letter has been sent, we will revoke the the website's "confirmed" or "verified" status. DigitSec will host the images that state a website is "confirmed", "verified", "trusted" etc. (hereafter: SEALS). If the seals aren't available due to hosting errors or unavailability of our website or the websites that host the images, we cannot be held responsible in any way. The customers may always (request to) host the images themselves. DigitSec may request, at any time, that certain customers host the images themselves. The customers may NOT change the code used to insert the graphics we provide them with in ANY way, unless directed to do so by a DigitSec employee. The graphics are valid for one (1) domain (subdomain) only, but may be displayed on any of the pages on that domain (subdomain). If a customer wants to verify another website, the customer should join us again under another e-mail address. DigitSec currently puts no limit on the number of seal impressions. Once a customer's website is "confirmed", "approved", "verified" etc., the customer is granted access to multiple graphics and may display any and all of them on the confirmed website only. If a customer fails to pay a subscription fee, the customer will have three (3) days to send the reqired payment. If the customer doesn't manage to pay the fee, the customer's website will be "rejected" and the customer will have to to remove our graphics or legal actions may be taken due to breach of international copyright laws. DigitSec may, at any given time, reject your verified website in order to investigate complaints made to DigitSec by your customers. In such cases, you may need to provide DigitSec with additional company information (e.g. payment proofs). Your refusal to do so will have your website listed as rejected. Upon verifying the additional information, your website's verified status will be reinstated. If the customer's claims are proven to be true, your website will be permanently rejected until the customer revokes the complaints made to DigitSec or until DigitSec decides to reevaluate the website (company) in question. In conclusion, the website verification process has 10 + 1 points: - review of the website's disclaimer - review of the website's privacy policy - review of the website's terms of use (and refund policy if applicable) - review of the website's contact page (a website must list at least two out of the following three means of contact: e-mail address (or contact form), telephone number, physical address) - all links must be working and point to valid websites - a website must not link to "bad neighbourhoods" (e.g. known scam websites) - website content must be appropriate (must obide by our website submission terms listed HERE) - e-mail address verification - company's (support) telephone number verification - physical address confirmation and, in special cases, - the company must provide DigitSec with payment proofs (screen shots of the company's bank account, e.g. PayPal or AlertPay account(s), where log in e-mail address(es) and payments sent must be visible) If a company fails to pass ANY of the above mentioned verification points, the company's website will be listed as "rejected". DigitSec reserves the right to reject any website, based on website's content, as is stated in our website submission terms.
